US Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The case originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her order, the court pointed out that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
